YOU ALSO AGREE TO COMPLY WITH ALL APPLICABLE LAWS AND REGULATIONS REGARDING YOUR USE OF THE SITE AND ITS SERVICES. The Site and the Service, including all its features and functionalities, instant streaming, our website and user interfaces, as well as all content and associated software, are offered under these Terms and any other agreements or documents referenced herein (collectively, the "Agreement"). By using the Site or the Service, whether as a Member User, recipient of an email from a registered User, or as a Provider User, you agree to the Agreement. If you do not wish to be bound by these Terms, you must immediately stop using the Site and the Service. The Agreement will only be binding when the Provider has agreed to provide you with the Service.
You agree that the Provider may modify the Agreement at any time without prior notice. Any changes will take effect immediately after the modified Terms are posted on the Site or if the Provider notifies you of such changes. If you continue to use the Site or the Service after such modifications, you will be deemed to have accepted the Agreement as amended. If you do not agree to the modified Terms, you must stop using the Site and the Service immediately.
It is your responsibility to maintain backups of all data you store on our Services. We do not guarantee protection against data loss or that our Services will be error-free. You must download your data before canceling the services. We will store your data according to these terms and the plan to which you are subscribed. If you decide to stop using our Services, make sure to download your data first, as we may delete it afterward. If we suspend your access for a violation of these Terms, we may deny you access to your data during the suspension, but we may retain it for evidentiary purposes. If we cancel your access due to a violation, we may delete your data immediately or retain it for legal reasons.
If you lose your password, you will also lose access to your data. We recommend following best security practices to protect your system and devices, such as security updates, firewall protection, and antivirus software. We will never ask for your password via email or request you to click on a link to log into your account.
Your membership may begin with a trial at a reduced cost ranging from 1 to 15 Euros, USD, or GBP, depending on the promotion. You will have a two (2) day period to enjoy the Service under this trial ("Trial"). The trial will begin once you successfully complete the payment process during registration. Please note that the trial fee is non-refundable.
If you do not cancel your subscription during the trial period, you will automatically be charged a renewal fee at the end of the trial, generally 81.79€ or its equivalent in USD or GBP, as specified during registration. If your payment method fails, we will attempt to charge again at intervals of 48 hours, 7 days, and 30 days. If all attempts fail, your account will be deactivated until payment is successfully made.
The monthly membership fee is 81.79 USD, 81.79 GBP, or 81.79 EUR, depending on the currency indicated in the promotion or trial. This fee will be automatically charged at the end of the trial period. If you cancel your membership, you will have access to the premium service until the end of the current billing period. Renewal fees are refundable if requested within 14 days of the charge. After this period, they are non-refundable.
By starting your membership, you authorize modernwebforge to charge the applicable monthly fee, as well as any other charges associated with your use of the service, to the payment method provided during registration. Prices exclude Value Added Tax (VAT) where applicable.
We may offer discounts or promotions at our discretion. You agree that the billed amount may vary based on promotions or adjusted fees, and you will be notified by email of such adjustments.
If a payment is not successfully processed due to card expiration, insufficient funds, or other reasons, we may suspend your access to the Service until a valid payment method is provided.
You can cancel your membership at any time. You will continue to have access to the Service until the end of the current billing period. You must cancel before the monthly renewal to avoid the next charge. Cancellations can be made from your account settings or by sending an email to info@modernwebforge.com.
Payments are refundable only if requested within 14 days of the initial charge. We do not provide refunds for partial membership periods or trials.
We reserve the right to cancel or restrict your use of the Service, with or without notice, for any reason, including violations of your responsibilities set forth in these Terms.
You must use the Services solely for legal and appropriate purposes. You agree not to use unauthorized technology or methods to access the Services, not to infringe third-party rights, not to introduce viruses, and not to disrupt the functionality of the Services. Collecting personally identifiable information without authorization is prohibited, among other actions not permitted as detailed in these Terms.
At our discretion, we may modify, suspend, or discontinue temporarily or permanently some or all of the Services, with or without notice. We will not be liable for such modifications or interruptions, although we may offer refunds, credits, or other considerations at our discretion.
We respect copyright and expect our users to do the same. You may not use our Services to infringe copyright. We reserve the right to remove infringing content without prior notice and to cancel the accounts of repeat infringers.
If you believe your copyrighted work has been infringed, you may send a notice following the instructions detailed in these Terms. Include a physical or electronic signature, a description of the copyrighted work, the location of the infringing material, your contact information, and statements under penalty of perjury.
The name, logo, and all product or service marks of modernwebforge are owned by the Provider. All other trademarks, logos, images, products, and company names appearing or mentioned on the website or any device are owned by their respective owners. Nothing in these Terms grants you any license or right to use, alter, or remove such material.
The Provider will not be liable to you for any failure or delay in the performance of its obligations under this Agreement due to events beyond its reasonable control. These events may include, but are not limited to, denial of service attacks, strikes, shortages, riots, insurrection, fires, floods, storms, explosions, acts of God, war, terrorism, governmental actions, labor conditions, earthquakes, material shortages, internet failures, or extraordinary connectivity issues experienced by major telecommunications providers and unrelated to the Provider's infrastructure or connectivity (each a "Force Majeure Event").
These Terms of Use will be governed and construed in accordance with the laws of Cyprus. Any dispute arising in connection with these Terms will be resolved in the competent courts of Nicosia, Cyprus.
For more information about our service and its features, or if you need help with your account, you can contact our customer support by sending an email to info@modernwebforge.com. In certain cases, Customer Support may better assist you using a remote access support tool, through which we can access your computer. If you do not wish to provide this access, you should not consent to support through the remote access tool, and we will assist you by other means.
We will send you information related to your account, such as payment authorizations, invoices, password changes, payment method updates, confirmations, and notices, exclusively in electronic format, such as emails to the email address provided during registration.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE USE OF THE SITE AND/OR SERVICE IS AT YOUR OWN RISK. THE PROVIDER AND ITS SUPPLIERS PROVIDE THE SERVICE "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, REASONABLE EFFORT, TITLE, AND NON-INFRINGEMENT. THE PROVIDER DOES NOT WARRANT THAT THE SITE OR SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
